Abstract
Objective: Empirically explain the collation of orders related to Farmacêutic Assistance; on the one hand, the orders of the public policy of Assistência Farmacêutica; On the other hand, judicial orders for the provision of medications.
Results: The studied municipality has 157,384 inhabitants. With 16 Basic Health Units and 6 pharmacists who serve SUS in 26 medication dispensing units (which is to analyze the prescription with the identification of the subject being treated, as this determines the paths taken in this process). Of these units, 6 are managed by a third-party company. In this scenario and considering the period of October, November and December 2011 we found the record of 177 items coming from judicial mandates and 132 items constant from the standardized list. The total number of tablets, dragees, capsules, ampoules or verified units is 3,627,445, of which 1,420,110 units are linked to standardized lists, 2,162,941 units to the Prefectural sub-stock and 44,394 to judicial mandates. However, when transformed into monetary acquisition values, the 44,394 units represent R$ 418,930.28 and the remaining 3,583,051 units, R$ 460,051.19. While each unit originating from two judicial processes is equivalent to R$ 9.44; The standardized values are equivalent to the unit value of R$ 0.13. Virtually all requests are granted on a preliminary basis, or that imply the delivery of medication, without prior defense by the manager. Another result of this study is that the judicial mandates require the Municipalities to bear expenses that in large part should be borne by the States or by the Ministry of Health.
Conclusions: It is proposed to reanalyze the dosages of some standardized medications with the possibility of including some judicially requested items. I suggest or study that prescribing doctors, advocates, promoters and judges deepen the study of legislation on the demands and responsibilities of each instance of government. The management opens actions of planning, execution, support and evaluation of results.
